Questions
Does Georgia Require a Trade Name to Be Published in a Newspaper?
Yes. Under O.C.G.A. § 10-1-490, after you register a trade name with the clerk of superior court, a notice runs in the county's legal organ once a week for two weeks.
What Does This Service Include?
Publication of your trade name notice in the Fulton County legal organ, once a week for two weeks, and the Publisher's Affidavit, which we deliver to you as your proof of publication.
Do You File the Trade Name With the Clerk for Me?
No. This is a publication-only service. You register the trade name with the clerk of superior court yourself before you order, and you pay the clerk's fee directly to the clerk. We do not file the application for you.
What Do I Need Before I Order?
Your clerk-stamped trade name application. The newspaper won't run the notice until it has the stamped copy, so publication can't begin until you provide it. Owner signatures on the Fulton County Clerk of Superior Court's application must be notarized, and the clerk's published processing standard for trade name applications is within four weeks.
Is the Clerk's Fee Part of Your Price?
No. The Fulton County Clerk of Superior Court's fee is $175, paid by you directly to the clerk. It is not part of our $89 and doesn't go through our checkout.
Can I Cancel?
Yes, for a full refund at any time before we submit your notice to the newspaper. If there's an error in the notice that we or the newspaper made, we correct it at our expense. Once a notice is in the newspaper's production, a cancellation follows the newspaper's own deadline and must reach us in writing before it.
What Happens to the Publisher's Affidavit?
The newspaper emails it on the last day of publication, and we deliver it to you. Georgia's instructions direct the registrant to keep the Publisher's Affidavit; it is not re-filed with the clerk.
PublishProof is a publication service, not a law firm, and does not give legal advice.
