Illinois Questions

Who Has to Publish an Assumed Name in Illinois?

Sole proprietors and general partnerships that file an assumed name certificate with their county clerk. Illinois LLCs and corporations file assumed names with the Secretary of State and have no newspaper publication requirement.

Is the Newspaper's Publication Charge Included in the Price?

Yes. Our price is all-inclusive of publication: the newspaper's charge for all three weekly runs is inside it. You never pay the newspaper separately, and nothing is added later for the publication. The only other cost is the county clerk's filing fee, which you pay to the clerk when you file.

What Do I Do Before I Order?

File your assumed name certificate with your county clerk and pay the clerk's filing fee yourself. The clerk's fee is never part of our price. Then order here with the date the clerk filed your certificate.

What Are the Deadlines?

They count from the date the clerk filed your certificate. The first publication must run within 15 days after the filing. The notice runs once a week for three weeks in a row. The newspaper's certificate of publication must be filed with the county clerk within 50 days after the filing, or the registration is void. (Assumed Business Name Act, 805 ILCS 405.)

What If My Filing Date Is Too Old?

When you enter your filing date, we check it against both deadlines before you pay. If the first publication can no longer run within 15 days of your filing, we tell you and don't take the order. Talk to the county clerk about your options.

Who Files the Certificate of Publication With the Clerk?

It depends on the county. In some counties the newspaper files it with the clerk directly; in others the newspaper sends it to us and we file it. Your county page says which, and we email you when it has been filed.

I Have an LLC or a Corporation. Do I Need This?

No. Illinois LLCs and corporations file assumed names with the Illinois Secretary of State, and there is no newspaper publication requirement for them. We can't take an order for an LLC or corporation.

Can I Cancel?

Yes, for a full refund at any time before we submit your notice to the newspaper. If there's an error in the notice that we or the newspaper made, we correct it at our expense.
